Este trabajo investiga las interrelaciones entre la regulación y los as-pectos económicos y ambientales en una comunidad de agricultores familiares en la región conocida como Zona da Mata Mineira, en el estado brasileño de Minas Gerais. El estudio es producto de una acti-vidad de extensión realizada entre 2016 y 2018, y tuvo como objetivo asesorar a los pequeños productores en el proceso de adecuación legal de la producción. Durante este período se realizaron cerca de cinco reuniones entre investigadores y comuneros, (...) en las que se analizaron las dificultades encontradas por los pequeños productores en relación con el referido proceso. Las experiencias reportadas fueron confron-tadas con el régimen legal regulatorio para la actividad acuícola en Brasil, tomando como categorías de análisis los atributos de norma-tividad y facticidad del sistema legal. Se concluyó que la regulación ambiental en el área de la acuicultura en Brasil, diseñada para grandes productores, carga de manera desproporcionada a los pequeños pro-ductores, generando un desequilibrio económico injustificado. Como aporte a la teoría, se propone, en definitiva, la formulación de un con-cepto de regulación jurídica inclusiva, cuyos rasgos distintivos inclu-yen la participación social y la promoción de la alfabetización jurídica como derecho fundamental. In this paper we suggest that Duffley’s sign-based semantics rests on two main claims: a methodological one and an ontological one. The methodological one is the analysis of corpora and the ontological one is the postulate of mental content. By adopting a linguistic enactivist perspective with a Wittgensteinian twist, we endorse Duffley’s methodological claim and suggest that a sign-based semantics doesn’t have to rely on mental content if it takes into account the conception of meaningful material engagement in cognitive archeology (...) and its development into sign-using as an enactive capacity. In this introduction we present Patrick Duffley's book Linguistic Meaning meets Linguistic Form, as well as the contributions that each scholar has brought into the debate on linguistic meaning and form. They deal with semantic and foundational issues regarding a sign-based approach to meaning.

Sustainable development requires several stakeholders, including companies, to take action. For this, employees need to have their positions and sustainability roles defined so they can carry out activities. In turn, activities need alignment with corporate policies and strategy. However, the literature lacks discussion about job specifications and which activities relate to sustainability. Therefore, this article aims to explore the panorama of positions and professional activities of corporate sustainability professionals. To achieve this goal, we conducted a bibliometric assessment of terms related (...) to corporate sustainability professionals and to understand what scholars have addressed in the area thus far. In the second stage, we tackle this problem by conducting a world survey of 143 professionals working in sustainability-related positions. The methods are complementary because they provide different types of information that can be used to gain insights into research topics and trends. In this sense, this research contributes to the literature and practice in two main ways. First, the sustainability professionals' positions are still recent and under construction; few sustainability professionals are leaders. Second, this research identified that the sustainability professionals' actions focus on the environmental dimension, suggesting that companies have to invest more in social and governance dimensions. In addition, the findings evidence the need for more reporting on these dimensions as well as aligning all sustainability-related policies, practices and activities with the strategy's company. Theoretical and practical implications, such as the need for more training on sustainability aspects, and the study's limitations are also addressed. (shrink)

Several theists, including Linda Zagzebski, have claimed that theism is somehow committed to nonvacuism about counterpossibles. Even though Zagzebski herself has rejected vacuism, she has offered an argument in favour of it, which Edward Wierenga has defended as providing strong support for vacuism that is independent of the orthodox semantics for counterfactuals, mainly developed by David Lewis and Robert Stalnaker. In this paper I show that argument to be sound only relative to the orthodox semantics, which entails vacuism, and give (...) an example of a semantics for counterfactuals countenancing impossible worlds for which it fails. La doctrine philosophique préparée par la révolution copernicienne ne semble pas faire sa part au politique. En effet, le système de la philosophie se divise en liberté et nature, le politique ne pouvant être réduit ni à l'autre. Cependant, on peut dégager l'originalité du politique chez Kant précisément à partir de cette difficulté d'accommodation. On verra alors s'esquisser un rapprochement stylistique entre Kant et l'idéalisme allemand: dans les deux cas, l'intelligibilité du présent est rapportée à la médiation entre normativité et (...) expérience. It seems that there is no place to politics in the philosophical doctrine orchestrated by the Copernican revolution. Indeed, none of the two parts of the philosophical system — nature and freedom — can alone give a satisfactory account of politics. However, it is arguable that by reflecting on this topical difficulty one could detect the originality of Kant's approach to the political. By proceeding in this way one is also able to recognize a stylistic nearness between Kant and the philosophers of German Idealism: in both cases, the intelligibility of the present is related to the mediation between normativity and experience. O feminismo interseccional tem sido apontado como uma importante teoria na compreensão de como as opressões de gênero, classe e raça dentre outras, se relacionam entre si e interferem na vida de cada mulher, que acaba assim por experimentar a opressão de gênero a partir de um ponto de vista único. Além disso, a atuação de coletivos feministas tem sido fundamental na vida de mulheres, como espaços de empoderamento e de luta em prol de uma sociedade menos opressiva. Assim, apresentamos (...) nesse trabalho o processo de adoção do feminismo interseccional como ferramenta teórico-metodológica por um coletivo feminista da Bahia, Brasil. Para tanto, realizamos um relato das atividades desenvolvidas pelo grupo entre os anos de 2013 e 2017. Foi possível identificar o forte vínculo afetivo estabelecido entre as companheiras e como o discurso interseccional tem sido importante nesse processo e nas ações do Coletivo como um todo. Constatou-se, assim, que a utilização deste referencial pode ser poderosa no sentido de contribuir para diálogos mais inclusivos e assim mais transformadores. Corroborando, ainda, com a ideia da extrema relevância da articulação entre o feminismo acadêmico e a ação política, além de destacar os desafios da consolidação de coletivos que nascem no âmbito acadêmico. A investigação transcendental pressupõe um exercício de abstração, que na Crítica da Razão Pura se aplica ao conhecimento da experiência. Sua bipartição em dois modos-de-representação, contudo, levanta duas dificuldades à teoria da objetividade kantiana: como conciliar os, elementos separados pela análise e como assegurar a legitimidade da abstração sobre o conhecimento empírico.

Embodied approaches to human cognition emphasize the role of the body in processes of linguistic comprehension and production. Several empirical studies have presented support to these approaches. The recent linguistic enactivist approach to cognition stands out for suggesting that we have to deepen our concept of the body. In this context, we present: 1) neurological and psychological evidence supporting the claim that concepts are embodied; 2) two theoretical approaches to embodied cognition in the cognitive sciences: the grounded cognition approach, and (...) one approach based on dynamic systems theory – our focus is on how these theories consider the conceptual system; and 3) the enactivist linguistic approach to cognition. Then, based on introductory clarifications on these three theories, we suggest that the empirical evidence supports only a shallow perspective of the role of the body in cognition, by the linguistic enactivist standards, and we emphasize the importance of understanding the empirical reach of linguistic enactivism. Populism is widely thought to be in tension with liberal democracy. This article clarifies what exactly is problematic about populism from a liberal–democratic point of view and goes on to develop normative standards that allow us to distinguish between more and less legitimate forms of populism. The point of this exercise is not to dismiss populism in toto; the article strives for a more subtle result, namely, to show that liberal democracy can accommodate populism provided that the latter conforms to (...) particular discursive norms. What the article calls a ‘liberal ethics of populism’ turns out to be closely bound up with a broader ethics of peoplehood, understood as a way of articulating who ‘the people’ are in a way that is compatible with liberal–democratic principles of political justification. Such an ethics, concludes the article, inevitably has a much wider audience than populist political actors: its addressees are all those who seek legitimately to exercise power in the name of the people. In a recent paper, Pruss proves the validity of the rule beta-2 relative to Lewis’s semantics for counterfactuals, which is a significant step forward in the debate about the consequence argument. Yet, we believe there remain intuitive counter-examples to beta-2 formulated with the actuality operator and rigidified descriptions. We offer a novel and two-dimensional formulation of the Lewisian semantics for counterfactuals and prove the validity of a new transfer rule according to which a new version of the consequence argument can (...) be formulated. This new transfer rule is immune to the counter-examples involving the actuality operator and rigidified descriptions. However, we show that counter-examples to this new rule can also be generated, demanding that the Lewisian semantics be generalized for higher dimensions where counter-examples can always be generated. René Girard afirma que a sua teoria sobre a origem da origem cultura è um longo argumento, em palavras de Charles Darwin, com quem o autor francês encontra uma afinidade notável: tanto Darwin como ele próprio, diz Girard, concebem o sacrìfício como o fundamento da ordem natural e da cultura humana. Foi dito que, como o evolucionismo darwiniano, a teoria mimètica de Girard "propõe uma dinâmica, mostra uma evolução e tenta apresentar uma explicação universal" (Michel Serres). O propósito desta comunicação (...) è examinar a tese da analogia de ambas as teorias à luz de uma dupla interrogação: A teoria da origem da cultura de René Girard pode ser considerada um desenvolvimento possível do evolucionismo de Darwin? Ou, pelo contrário, a afinidade entre as duas doutrinas consiste meramente na inclusão de fenómenos de violência e de sacrificio no processo etològico e antropológico de hominização e evolução cultural? Defendo que a teorìa mimètica de Girard segue a via científica da doutrina evolucionista de Darwin e que a presença em ambas da violência e do sacrificio não è meramente circunstancial. René Girard has stated that his theory of the origin of culture is one long argument, in words borrowed from Charles Darwin, with whom the French author finds a remarkable affinity: both Darwin and himself, says Girard, conceive of sacrifice as being the foundation of natural order and of human culture. It has been said that, like Darwins, Girards mimetic theory "proposes a dynamic, shows an evolution and intends to give a universal explanation' (Michel Serres). The purpose of this paper is to examine the thesis of the analogy of both theories in the light of a main double question: Is Girard's theory of the orìgin of culture a possible development of Darwin's evolutionism? or, on the contrary: Does the affinity between both doctrines consist merely of the inclusion of violence and sacrifice in the ethological and anthropological process conducing to hominization and cultural development? I argue that Girard's mimetic theory follows the scientific path of Darwin's doctrine of evolution and that the presence in both works of violence and sacrifice is not merely circumstantial. Focused on city-scale automation, and using self-driving cars (SDCs) as a case study, this article reflects on the role of AI—and in particular, computer vision systems used for mapping and navigation—as a catalyst for urban transformation. Urban research commonly presents AI and cities as having a one-way cause-and-effect relationship, giving undue weight to AI’s impact on cities and overlooking the role of cities in shaping AI. Working at the intersection of data science and social research, this paper aims to counter (...) this trend by exploring the reverse perspective: how do cities affect the development, and expose the present limits, of SDCs? The contribution of this paper is threefold. First, by comparing urban and nonurban environments and thoroughly examining the relationship between computer vision and city-specific sociality and form, it defines machine autonomy/automation as a function of the sociotechnical milieu in which an AI system operates. Second, and related, the paper problematizes the notion of SDCs as autonomous technologies and the role it plays in envisioning contending policy arrangements and technical solutions for achieving full driving automation. Finally, the article offers insight into a materialist and spatialized understanding of AI—namely, not as an abstract quality susceptible to replication within discrete machines, but rather as a distributed property emerging through embodied interactions among a multiplicity of agents (human, non-human, and technological) within/with their environments. Our objective in this paper is twofold: first, we intend to address the tenability of the enactivist middle way between realism and idealism, as it is proposed in The Embodied Mind. We do so by taking the enactivist conception of bringing forth a world literally in three conceptual levels: enaction, niche construction and social construction. Based on this proposal, we claim that enactivism is compatible with the idea of an independent reality without committing to the claim that organisms have cognitive (...) access to a world composed of properties specified prior to any cognitive activity. Our second goal is to show that our literal interpretation of bringing forth a world not only sustains the legitimacy of the middle way, but it also allows us to revive the conception of evolution as natural drift—which is perhaps the least examined aspect of the original enactivist theory and is central to the understanding of cognition in an enactive way. Natural drift focuses on how structural couplings between organism and environment trigger viable pathways of maintenance and reproduction, instead of selecting the most adapted trait to a pregiven environment. Thus, although enactivists typically do not explore the consequences of their views regarding evolutionary dynamics, we show how natural drift provides a suitable starting point. (shrink)

In a recent article, P. Roger Turner and Justin Capes argue that no one is, or ever was, even partly morally responsible for certain world-indexed truths. Here we present our reasons for thinking that their argument is unsound: It depends on the premise that possible worlds are maximally consistent states of affairs, which is, under plausible assumptions concerning states of affairs, demonstrably false. Our argument to show this is based on Bertrand Russell’s original ‘paradox of propositions’. We should then opt (...) for a different approach to explain world-indexed truths whose upshot is that we may be morally responsible for some of them. The result to the effect that there are no maximally consistent states of affairs is independently interesting though, since this notion motivates an account of the nature of possible worlds in the metaphysics of modality. We also register in this article, independently of our response to Turner and Capes, and in the spirit of Russell’s aforementioned paradox and many other versions thereof, a proof of the claim that there is no set of all true propositions one can render false. Popular sovereignty requires that citizens perceive themselves as being able to act and implement decisions, and that they are de facto causally connected to mechanisms of decision making. I argue that the two most common understandings of the exercise of popular sovereignty—which center on direct decision making by the people as a whole and the indirect exercise of democratic agency by elected representatives, respectively—are inadequate in this respect, and go on to suggest a complementary account that stresses the central role (...) of internally democratic and participatory political parties in actualising popular sovereignty, drawing on the democratic theory of Hans Kelsen. Logical Holism and Wittgenstein’s ‘Practical Turn’. – Logical holism is the idea that each elementary proposition belongs to a system and is logically connected to other propositions of that system. In this paper I explore this idea and draw its connections to the nature of negative propositions and the ‘problem of recognition’ on the basis of Wittgenstein’s Nachlass. In the first section I argue that in January 1930 the idea leads Wittgenstein to a better understanding of how the negative feature (...) is expressed in propositions, thereby raising the problem of recognition to which he is not yet able to find a proper solution. In the second section I explore how the problem still persists during Wittgenstein’s ‘practical turn’. What he now calls the ‘problem of representation’ forces him to change again his conception of propositions. In the final section I argue that this change is mainly due to the modification of his conception of hypotheses which urges a solution to the problem of representation, though the problem remains unsolved in January 1930. Populist movements have become key players in European politics. These movements are readily criticized by journalists or political rivals, yet none of the common objections to populism seems to arrest their success. This article turns to normative political theory to cultivate sensitivity to problems arising from some existing arguments against populism, and to explore possible alternatives. It offers a critical reading of prototypical liberal and conservative arguments against populism, and proposes that the principles of solidarity and procedure provide good grounds (...) for a sustainable critique of populism. It is a widely held principle that no one is able to do something that would require the past to have been different from how it actually is. This principle of the fixity of the past has been presented in numerous ways, playing a crucial role in arguments for logical and theological fatalism, and for the incompatibility of causal determinism and the ability to do otherwise. I will argue that, assuming bivalence, this principle is in conflict with standard views about (...) knowledge and the semantics for ‘actually’. This chapter tries to answer the following question: How should we conceive of the method of mathematics, if we take a naturalist stance? The problem arises since mathematical knowledge is regarded as the paradigm of certain knowledge, because mathematics is based on the axiomatic method. Moreover, natural science is deeply mathematized, and science is crucial for any naturalist perspective. But mathematics seems to provide a counterexample both to methodological and ontological naturalism. To face this problem, some authors tried to naturalize (...) mathematics by relying on evolutionism. But several difficulties arise when we try to do this. This chapter suggests that, in order to naturalize mathematics, it is better to take the method of mathematics to be the analytic method, rather than the axiomatic method, and thus conceive of mathematical knowledge as plausible knowledge. There are three main accounts of scientific progress: 1) the epistemic account, according to which an episode in science constitutes progress when there is an increase in knowledge; 2) the semantic account, according to which progress is made when the number of truths increases; 3) the problem-solving account, according to which progress is made when the number of problems that we are able to solve increases. Each of these accounts has received several criticisms in the last decades. Nevertheless, some authors (...) think that the epistemic account is to be preferred if one takes a realist stance. Recently, Dellsén proposed the noetic account, according to which an episode in science constitutes progress when scientists achieve increased understanding of a phenomenon. Dellsén claims that the noetic account is a more adequate realist account of scientific progress than the epistemic account. This paper aims precisely at assessing whether the noetic account is a more adequate realist account of progress than the epistemic account. (shrink)

The aim of this thesis is to advance a philosophically justifiable account of Artificial Moral Agency (AMA). Concerns about the moral status of Artificial Intelligence (AI) traditionally turn on questions of whether these systems are deserving of moral concern (i.e. if they are moral patients) or whether they can be sources of moral action (i.e. if they are moral agents). On the Organic View of Ethical Status, being a moral patient is a necessary condition for an entity to qualify as (...) a moral agent. This view claims that because artificial agents (AAs) lack sentience, they cannot be proper subjects of moral concern and hence cannot be considered to be moral agents. I raise conceptual and epistemic issues with regards to the sense of sentience employed on this view, and I argue that the Organic View does not succeed in showing that machines cannot be moral patients. Nevertheless, irrespective of this failure, I also argue that the entire project is misdirected in that moral patiency need not be a necessary condition for moral agency. Moreover, I claim that whereas machines may conceivably be moral patients in the future, there is a strong case to be made that they are (or will very soon be) moral agents. Whereas it is often argued that machines cannot be agents simpliciter, let alone moral agents, I claim that this argument is predicated on a conception of agency that makes unwarranted metaphysical assumptions even in the case of human agents. Once I have established the shortcomings of this “standard account”, I move to elaborate on other, more plausible, conceptions of agency, on which some machines clearly qualify as agents. Nevertheless, the argument is still often made that while some machines may be agents, they cannot be moral agents, given their ostensible lack of the requisite phenomenal states. Against this thesis, I argue that the requirement of internal states for moral agency is philosophically unsound, as it runs up against the problem of other minds. In place of such intentional accounts of moral agency, I provide a functionalist alternative, which makes conceptual room for the existence of AMAs. The implications of this thesis are that at some point in the future we may be faced with situations for which no human being is morally responsible, but a machine may be. Moreover, this responsibility holds, I claim, independently of whether the agent in question is “punishable” or not. (shrink)

Purpose This study aims to explore whether face recognition technology – as it is intensely used by state and local police departments and law enforcement agencies – is racism free or, on the contrary, is affected by racial biases and/or racist prejudices, thus reinforcing overall racial discrimination. Design/methodology/approach The study investigates the causal pathways through which face recognition technology may reinforce the racial disproportion in enforcement; it also inquires whether it further discriminates black people by making them experience more racial (...) discrimination and self-identify more decisively as black – two conditions that are shown to be harmful in various respects. Findings This study shows that face recognition technology, as it is produced, implemented and used in Western societies, reinforces existing racial disparities in stop, investigation, arrest and incarceration rates because of racist prejudices and even contributes to strengthen the unhealthy effects of racism on historically disadvantaged racial groups, like black people. Practical implications The findings hope to make law enforcement agencies and software companies aware that they must take adequate action against the racially discriminative effects of the use of face recognition technology. Social implications This study highlights that no implementation of an allegedly racism-free biometric technology is safe from the risk of racially discriminating, simply because each implementation leans against our society, which is affected by racism in many persisting ways. Originality/value While the ethical survey of biometric technologies is traditionally framed in the discourse of universal rights, this study explores an issue that has not been deeply scrutinized so far, that is, how face recognition technology differently affects distinct racial groups and how it contributes to racial discrimination. In recent times, representation theory has become one of the most productive and interesting sub-fields in democratic theory. Arguably, the most important theoretical innovation are the so-called ‘constructivist’ approaches to political representation. These approaches play a central role in Creating Political Presence: The New Politics of Democratic Representation and The Constructivist Turn in Political Representation, two impressive volumes that take stock of the state of the art in representation theory. I discuss the two volumes by focusing on three broader and (...) interconnected themes: the problem that constructivism is meant to respond to, the tendency of representation theorists to expand the possibilities of representation as broadly as possible, and the normative aspects of political representation and how constructivists deal with them. In response to the many social impacts of automated mobility, in September 2020 the European Commission published Ethics of Connected and Automated Vehicles, a report in which recommendations on road safety, privacy, fairness, explainability, and responsibility are drawn from a set of eight overarching principles. This paper presents the results of an interdisciplinary research where philosophers and engineers joined efforts to operationalize the guidelines advanced in the report. To this aim, we endorse a function-based working approach to support the implementation (...) of values and recommendations into the design of automated vehicle technologies. Based on this, we develop methodological tools to tackle issues related to personal autonomy, explainability, and privacy as domains that most urgently require fine-grained guidance due to the associated ethical risks. Even though each tool still requires further inquiry, we believe that our work might already prove the productivity of the function-based approach and foster its adoption in the CAV scientific community. BackgroundOrgan transplantation represents the most effective and acceptable therapy for end-stage organ failure. However, its frequent practice often leads to a shortage of organs worldwide. To solve this dilemma, some countries, such as Portugal, have switched from an opt-in to an opt-out system, which has raised concerns about respect for individual autonomy. We aimed to evaluate whether young university students are aware of this opt-out system so that they can make informed, autonomous and conscious decisions, as well as to identify (...) the factors that determine a positive attitude toward post-mortem organ donation.MethodsAn observational, cross-sectional study was developed and a questionnaire was administered to first-year students from six faculties of the University of Porto.ResultsOf the 841 participants, 60% were unaware that Portugal had adopted an opt-out system. Among the informed individuals, their main sources of information included social media, internet, and family. Furthermore, only 48% of all participants agreed with the current opt-out system. Female sex (p = 0.049; OR 1.393), knowledge of the law (p < 0.001; OR 4.749) and family being the primary source of information (p < 0.001; OR 2.855) were independent factors associated with a positive attitude toward post-mortem organ donation law.ConclusionsThere is a significant lack of knowledge among young university students regarding the presumed post-mortem organ donation law and how it works. Female sex, having family as a primary source of information and being aware of the presumed post-mortem organ donation law are the strongest independent factors that determine a positive attitude toward the opt-out system. In recent times, representation theory has become one of the most productive and interesting sub-fields in democratic theory. Arguably, the most important theoretical innovation are the so-called ‘constructivist’ approaches to political representation. These approaches play a central role in Creating Political Presence: The New Politics of Democratic Representation and The Constructivist Turn in Political Representation, two impressive volumes that take stock of the state of the art in representation theory. I discuss the two volumes by focusing on three broader and (...) interconnected themes: the problem that constructivism is meant to respond to, the tendency of representation theorists to expand the possibilities of representation as broadly as possible, and the normative aspects of political representation and how constructivists deal with them. In this paper, I explore Wittgenstein’s conception of a hypothesis as articulated in Chapters XII and XXII of ‘Philosophical Remarks’. First, I argue that in Chapter XII, Wittgenstein draws on his account of infinity to begin to challenge the view that all hypotheses can be proven by empirical evidence. I then argue that in Chapter XXII that Wittgenstein sharpens this conception of hypotheses claiming that no hypotheses can be verified. In this paper I critically evaluate the value neutrality thesis regarding technology, and find it wanting. I then introduce the various ways in which artifacts can come to influence moral value, and our evaluation of moral situations and actions. Here, following van de Poel and Kroes, I introduce the idea of value sensitive design. Specifically, I show how by virtue of their designed properties, artifacts may come to embody values. Such accounts, however, have several shortcomings. In agreement with Michael Klenk, (...) I raise epistemic and metaphysical issues with respect to designed properties embodying value. The concept of an affordance, borrowed from ecological psychology, provides a more philosophically fruitful grounding to the potential way(s) in which artifacts might embody values. This is due to the way in which it incorporates key insights from perception more generally, and how we go about determining possibilities for action in our environment specifically. The affordance account as it is presented by Klenk, however, is insufficient. I therefore argue that we understand affordances based on whether they are meaningful, and, secondly, that we grade them based on their force. (shrink)
